Terms & Services Agreement

1. Term & Service Period

Standard Service Duration: Services are provided on a per-job basis unless otherwise agreed upon in writing. This includes carpet cleaning, air duct cleaning, upholstery cleaning, rug cleaning, and emergency flood extraction.
Extended Services: For recurring services (e.g., regular maintenance or scheduled cleanings), additional fees may apply based on the scope and frequency of services requested.

2. Scheduling & Availability

Service Appointments: Available Monday to Saturday, from 8:00 AM to 6:00 PM, with pre-scheduled times.
Availability: Palmer’s Carpet Cleaning and Restoration aims to accommodate flexible scheduling. However, customer presence is required for certain services (e.g., flood extraction, air duct cleaning).
Missed Appointments: A fee prorated for the time allocated will be charged for missed appointments without prior notice. No refunds are available for missed appointments where services are scheduled.

3. Pricing & Additional Services

Inclusions: Pricing covers the agreed cleaning services, equipment, and labor. Specific service costs such as carpet cleaning, upholstery cleaning, air duct cleaning, rug cleaning, and emergency flood extraction vary and will be provided prior to service.
Additional Services: Custom requests such as deep-cleaning extras or specialized flood damage recovery may incur additional charges.
Special Requests: Additional fees may apply for unique service requests or expedited timelines.

4. Client Responsibilities

Preparation for Service: Clients are expected to prepare the area for cleaning (e.g., moving light furniture, securing pets). Palmer’s Carpet Cleaning is not responsible for damage to personal items not removed from the service area.
Data Accuracy (CRM Use): Clients using our services in conjunction with CRM systems must ensure all data provided is accurate and up-to-date.
Non-Compliance: Failure to follow preparation instructions may delay service and result in additional charges.

5. Data Usage & CRM Integration

CRM Services: We use a CRM system provided by The Real Estate Syndicate to manage client communications, appointment reminders, and follow-up services.
Data Responsibility: Clients are responsible for ensuring that any personal data provided complies with privacy laws and regulations.
Prohibited Data: Sensitive data (e.g., financial information, health data) must not be included in our CRM without proper consent and is subject to privacy regulations.

6. Access & Client Conditions

Access to Property: Clients must ensure Palmer’s Carpet Cleaning technicians have access to the property during scheduled service times.
Permits & Licensing: For any services requiring special permits or regulations (e.g., flood damage restoration), clients must ensure the necessary permits are in place.

7. Payment & Billing

Payment Due: Payments for services are due upon completion unless otherwise specified in advance.
Non-payment Consequences: Failure to pay within 30 days may result in suspension of future services and may incur additional late fees.
Billing Adjustments: Any billing discrepancies must be reported within 7 days. Additional charges will be applied to the client’s payment method if necessary.

8. Liability & Indemnification

Client Indemnity: Clients agree to indemnify Palmer’s Carpet Cleaning and Restoration against damages or losses related to the improper use of services or failure to follow recommended guidelines.
Limited Liability of Palmer’s Carpet Cleaning: We disclaim liability for indirect damages or losses related to the implementation of cleaning strategies or advice.

9. General Terms

Precedence: These terms override any prior verbal or written agreements unless specifically agreed to in writing.
Documentation: Clients are required to document any pre-existing damages in the service area and provide this documentation prior to service.

10. Additional Terms

Customer Accountability: Clients are responsible for ensuring their property is properly prepared for the scheduled service.
Adjustments Due to External Factors: Palmer’s Carpet Cleaning is not responsible for delays or changes caused by external factors (e.g., weather conditions, building access issues).
CRM Usage Guidelines: All CRM-related requests or adjustments must be coordinated through our office.

11. Confidentiality & Data Security

Client Confidentiality: All client data, including personal information, is treated confidentially and used solely for the purpose of providing our services.
Data Security: Palmer’s Carpet Cleaning uses industry-standard security measures to protect client data shared via our CRM. However, clients are responsible for safeguarding their access credentials.

12. Intellectual Property

Content Ownership: Any proprietary cleaning methods, training materials, or systems provided by Palmer’s Carpet Cleaning remain our intellectual property. Clients may use these materials only for their personal property maintenance.
Restrictions on Redistribution: Clients are prohibited from distributing, selling, or sharing any materials provided by Palmer’s Carpet Cleaning without prior consent.

13. Service Termination & Refund Policy

Termination by Client: Clients may cancel services with a minimum of 24 hours' notice. For ongoing service contracts, a 30-day written notice is required.
Termination by Palmer’s Carpet Cleaning: We reserve the right to terminate services for non-payment, misuse of services, or violation of these terms.
Refunds: Refunds are only available for services not yet performed. No refunds are provided for completed jobs or missed appointments.

14. Service Limitations & No Guarantees

Performance Disclaimer: While we strive to provide high-quality cleaning and restoration services, no guarantees are made regarding specific outcomes, such as stain removal or restoration results, which may depend on various factors.
Client Implementation: Palmer’s Carpet Cleaning is not responsible for improper use of our post-cleaning care advice, nor for damages caused by the client’s actions after services are rendered.

15. Changes to Terms & Conditions

Right to Amend: Palmer’s Carpet Cleaning reserves the right to amend these terms and conditions at any time. Clients will be notified of significant changes 30 days prior to implementation.
Notification of Changes: Clients will be notified of changes via email or phone communication.

16. Dispute Resolution & Governing Law

Dispute Resolution: Any disputes arising from these terms will be resolved through mediation or arbitration. If unresolved, legal action may be pursued in the jurisdiction where Palmer’s Carpet Cleaning operates.
Governing Law: This agreement is governed by the laws of Nebraska, where Palmer’s Carpet Cleaning and Restoration is headquartered.

17. Client Testimonials & Marketing

Use of Testimonials: Clients agree that any testimonials provided may be used for Palmer’s Carpet Cleaning’s marketing purposes, including website or social media content.
Opt-Out: Clients may opt out of testimonial usage by submitting a written request.

18. Service Availability & System Downtime

Service Availability: While we aim for consistent service availability, there may be rare instances of system downtime for our CRM. Clients will be notified in advance of any planned outages.

19. Performance Metrics & Reporting

Reporting Metrics: Clients will receive regular service performance reports, including feedback on CRM data usage and customer engagement metrics.
Client Feedback: We welcome client feedback to enhance our services. Feedback may be submitted through our office.
